Should I sue my dentist?
I had a root canal done last summer. The dentist broke off a piece of an instrument in my tooth, and did not complete the work. He neglected to tell me at the time that the procedure was not completely successful. I've had problems with the tooth ever since the root canal. I just had a retreatment of the tooth today by a specialist. Which cost me another $1400. Should my original dentist refund me for the work I had to have done to fix the original incompetence?
And how should I go about getting him to pay for it, preferably without legal action.

I think in this case, you are more than justified to sue. I appreciate your desire to get him to pay without legal action, but if he refuses, you really are justified to sue, I believe. Have you tried to just talk to him?

check the yellow pages for a lawyers. Usually they review costs on a case by case basis. In this case you can get good money so I bet theyll do it for free but for the fee of a %earned.
Heck yeah, the original dentist HAS to pay for it, especially if he botched the original surgery and did not tell you. Talk to a lawyer, who will likely take the case for free. THEN talk to the dentist. If he will not pay for the bill, mention the lawyer. If he still will not pay, proceed with legal action. Good luck!
Yes I think so because the dentist should have continued the root canal. But then again you already had the surgery.

I think he should pay for getting the tooth refixed. What I would do is to just talk to the first dentist. If that doesn't work then take a letter from the new dentist stating that the problems were because he broke off the instrument and take it to him and see what happens then.

I would talk to a lawyer first before you say anything to the dentist. He won't be able to cover his tracks that way!!

Definetely, mouth is one of the sensitive parts of the body which need loadz of care... if ur dentist did so... U urely sue him for it... hope u get ur expenses back for it... BEST OF LUCK

To the cleaners you will take him. From the description you've given he should not continue in the profession. If you think that's too drastic ask him to pay, if he refuses then to the cleaners you will take him. Get your documents in order talk to a lawyer.
Good lawsuit in my opinion. I am dealing with something like that myself. I had a root canal done and withen 2 days my tooth broke in half and caused a massive infection. Been a year and I am still in pain, he also went to fill a cavity and dripped the filling matter over 3 teeth. He was very clumsy. It's caused me to have more problems and loss of money than before I even saw him. I would sue.

when you undergo root canal surgery the dentist is obliged to tell you the things that can go wrong during the procedure and if something does go wrong then the dentist is legally responsible to tell you what happened. usually during root canals a endodontic file is used to remove the necrotic pulp. these are very thin instruments and they can and do break off. While it is not something the dentist wants to happen it is not something that the patient can sue for b/c you have consented to this when you go ahead with the treatment plan. however, if the dentist neglected to tell you that something went wrong or failed to tell you that it may not be a successful procedure then you might be able to get your money back. you have to keep in mind that your dentist is trying his or her best to treat you and health care can be difficult sometimes impossible chore. just becuase it doens't go as well as you might like doesn't mean you can sue somebody that is trying to help you.
First you need to report his incompetent behind to your health and human services so he doesnt do this to someone else then get a lawyer baby cuz youre about to get some money. I dont think you`ll get what you deserve without legal action.
